Anyone know labor law?
Tell me if you think this is legal? My husband is a service writer at a dealership. John's new "bonus" program. It is all based on CSI score (customer survice index --or rather customer service survey) If you meet X criteria for CSI score you get $900 If you meet a higher criteria you get an additional $100 If you score falls below criteria they CHARGE YOU $300 immediately withdrawn from your paycheck! In my mind a bonus is extra for going above and beyond. How is it legal to steal from your employee if they fall short? The worse part is the surveys that John has had bad referred to the mechanics not him yet are still held against him!
Yikes! Don't know about legalities but it definitely doesn't sound right. Just read your post to DH. He said, referring to your last sentence, "Yes, it's called 'accountability' and one of the things that stinks about being a manager!"
Wow, that does sound harsh!! I guess you take the good with the bad though. Do a great job and your rewarded for it, do a bad job and your penalized for it. Sure is a good incentive to do a good job! I agree with Trina about it being accountability!!
He is NOT a manager. He is the person who waits on you when you take your vehicle in for warranty repair. The mechanics do not answer to him so if there is a negative about them on his survey it only affects him. So the accountability is not really the explanation here.
Just want to mention that he IS getting the bonus this month and normally he has a high score. I just am very angry about this scare tactic in particular because as a comission only position he works so hard for the money he gets. The surveys are not a fair judgement of his work. I bet most people do not even realize that unless you mark "completely satisfied" on the survey he fails. Anything less than "completely satisfied" is a negative survey and gets counted against him. Before I knew this I never checked completely satisfied.
If you want to know if it is legal, talk to the wage and hour board in Florida or the state department which oversees employment law violations. The easiest way to find out which department to call is to call your local state legislator's office - you could even ask them your question and they may be able to give you the answer.
