Insurance question?
I posted before that a ladder flew out of the back of a pickup truck yesterday and bounced of dh's hood, smashed the windshield and hit his bike. The bike is about 2 weeks old and it's pretty much trashed, probably several thousand dollars worth of damage. Who do we file a claim with for the bike? Auto or home? The bike was on a bike rack attached to the car. Also can you say you want the parts replaced (since it was brand new) instead of repaired?
I would think you would report it to the car insurance.
If you have the same company they will file it correctly for you,
Absolutely report it to your auto insurance company first - and quickly.
Thanks, they are the same company and dh already spoke with them and they are taking care of it.
aaaaarrggghhh - looks like the other driver has no insurance.
Which means I hope with all my heart you were carrying Underinsured and Uninsured Motorist coverage. Also, did the other driver live alone? If he lives with his family, in some states their auto insurance may be liable if he is not insured. Talk to your insurance agent and, if necessary, talk to a lawyer. Your losses are substantial and there should be a way for you to get reimbursed.
thankfully, our insurance will cover the car, but if we want the bike covered we have to claim it under homeowners and then pay the deductable. However, dh spoke with the uninsured driver (illegal in this state to not have insurance) and he wants to set things right and pay for the bike and rack. So HOPEFULLY this will work out.
In my state, Pennsylvania, if an uninsured driver hits you and you sue him (in small claims court, usually) and get a judgment, you send a copy of the judgment to the Motor Vehicle Bureau and they pull his license (in PA and s/he also cannot get a license in any other state) until they pay the judgment.
