Wondering what happened?

Moms View Message Board: General Discussion: Archive June 2004: Wondering what happened?
By Momaroze on Thursday, May 27, 2004 - 10:07 pm:

Wanted an update regarding that horrific post. I don't remember who posted, but it was about the little girl who ended up in the hospital because the father had hurt her. The step mother just stood by and did nothing. I remember the post said the mother had to drive a far distance to get to the hospital to see her daughter, something like 11 hours?

How is the girl doing?

Hi, that was me that posted.. I have to try and get ds to bed, but I will post an update tomorrow!!

By Kaseys on Sunday, May 30, 2004 - 01:02 am:

Hi, sorry for such a late update.. That are transfering Brinkley to a hospital closer to home, she is brain dead on the right side, they are keeping her in an induced coma, when she does come out of the coma, all she does is cry, they don't know if she is hurting or what, (she is only 2 so she can't really tell them) and she reconizes (sp) her mama sometimes and then sometimes she doesn't.. As for the dad, he is still in prison, please continue to keep all of them in your prayers, and I will keep you updated.. Thanks everyone for being so concerned..

That is so sad.... I will keep them in my thoughts for sure.....

By Amecmom on Sunday, May 30, 2004 - 09:39 am:

Thanks for the new, even though it's sad. I"ll keep her and her mom in my prayers and pray that justice is done for her, although in this case, I don't really know what justice is.:(.

Thank you for the update. I will also continue to pray. That Mom must be a basket case I can't even imagine.

Thanks Kasey.

Very sad. That poor little baby :(

I don't know why I was expecting to hear something positive. Praying for a full recovery.

By Cocoabutter on Monday, May 31, 2004 - 09:34 pm:

I will pray too.

I just happened to think- has any legal action been taken against the step-mom?

I'm not suggesting vengeful action, but could she be held accountable as a accessory?

By Bobbie~moderatr on Tuesday, June 1, 2004 - 01:17 am:

You would surly think so wouldn't you??? I mean she sat there after the first time he put his hands on that child and did nothing. Thus she is an accessory.....

Mercury News

Deputy District Attorney Cameron Bowman...."We believe that he(the person being charged with accessory to murder)attempted to try to cover up the crime (of murder)after it was committed....We think he (the person being charged as an accessory)was there at the shooting and he (the person being charged with accessory) was involoved in trying to stop others from coming forward." (www.Mercurynews.com)

Based on that quote, it looks like, if a person

a)tries to cover up the crime
b)was there when the crime was committed
c) and tries to stop others from coming forward

then, yes, they can be charged with accessory.

Is that what the step-mom did? I admit I did not read the original post.

I think it goes, arrest, hearing of indictment, charge, trial and if found guilty, sentencing. Old Pre-Law course from back in my college days.

And I am not sure, but I think it would be at the discretion of the DA as to whether or not charges would be heard.

The charge would probably be something like:

Accessory to attempted murder of a minor child.

U.S. vs. step mom

According to Federal Sentencing Guideline Manual 2002 the crime would probably fall under the heading of "Accessory to assault with an attempt to commit murder against a minor" it is an offense level 22-28 (depending on circumstances of the charge and criminal history of the defendant) and carries a sentence of 41-97 years, it looks like 41 would be the minimum.

I don't know about parole. Probably would depend on the circumstances.

I did not read the original post because I have some personal issues with this kind of stuff and I don't need any more trouble sleeping!

But I will pray for the little girl.

The Federal Sentencing Guideline Manual is on the internet as well. Just type it into the Google Search.
