Bankruptcy Again
I was wondering for the people who have been through bankruptcy how long it took you to get your discharge letter and if you did chapter 7 or 13.We went to court on Dec.14th and we havent' received anything yet.Also we are surrendering our house so until we get those papers we cannot get another place to live not even an apartment?Thanks so much.Also if anyone knows what's the least amount of time can it take for the mortgage company to send us a letter about a sherrifs sale and how long do they have to give us to get out.

This group is a great source of information, and you can search by keyword to try to research your questions, or you can make a new post and let people who have experience with this answer your questions. We had to file a few years ago due to overwhelming medical bills and also scum-sucking bottom-feeding cc companies who decided to raise our interest rates to 29.99% even though we had never made a late payment to them. If you are doing a Chapter 7 it can take a while before you get your discharge. They have to give the creditors a set amount of time to file objections. One of our clients had his hearing on the 22 of December and the creditors have until Feb 20 to file objections. After that date passes, then there's time involved for the court to process you. It can take a minimum of six weeks. Did you have an attorney? Have the attorney call the trustee to see what's going on, or if not, call the trustee yourself. Good luck. Ame
My DH went through this with his ex, and says he got his discharge papers 30 days or so after he went to court. He filed Chapter 7. I know someone else have who filed their house too, and moved in with family after the foreclosed, so you need to check with your lawyer. My DH filed before all of the law changes. Of course, you can choose to reaffirm any debts you'd like, or at least that is how it was in TX. He filed on his house, but then continued to make payments, so that "reaffirmed" his mortgage. If you are just going to go rent, you shouldn't need discharge papers, if the apartment people ask why you have a house on your CR, tell them to call your lawyer, and he'll explain. I don't want to discuss TOO much here on the boards, but I **Think** I know who you are, and you know how to get ahold of me.
